LAHORE:The Lahore High Court (LHC) released notices to the federal government, Election Commission of Pakistan, speakers of the National and provincial assemblies on a plea seeking cancellation of membership of PML-N leader Chaudhry Nisar Ali Khan.
The cancellation is made on the grounds that PML-N leader Chaudhry Nisar Ali Khan has not taken oath as a member of assembly after three months of election, and therefore, he should be disqualified as a member of assembly.
High Court bench has given order to all the bodies to submit their responses by the next hearing.
The petition clearly told the law that this is a violation of law if an elected members fails to take Oath even after 3,4 months of election.
“Chaudhry Nisar is not taking oath after being elected as MPA in the Punjab Assembly,” he added.
The petition also urged that law be changed to and oath taking as member during the oath-taking ceremony should be made mandatory after election.
“A time period should also be specified for oath-taking and those who don’t abide by should be declared ineligible”, the petitioner remarked.
House members gave suggestions that the seat be declared vacant in case an elected member does not take oath within three months. PTI lawmaker out forward this recommendation.
